Marshal CRM

Terms of Service

Effective 21 October 2026

These terms govern your use of Marshal CRM, provided by Headway ("we", "us"), through https://crm.marshal.co.ls and the Marshal CRM mobile app (the "Service"). By creating an account or using the Service, you agree to these terms. If you use the Service on behalf of an organisation, you confirm that you are authorised to accept these terms for it.

1. Accounts

2. Your data

Your organisation owns the data it puts into the Service ("customer data"). You give us permission to host, process and display customer data only as needed to provide and support the Service. You are responsible for having a lawful basis to store and contact the people in your CRM, and for following the laws that apply to your sales and marketing, including data-protection and anti-spam laws. Our handling of personal information is described in our Privacy Policy.

3. Acceptable use

You agree not to:

4. Connected services

You may connect third-party services such as Google Calendar or Microsoft Outlook. When you do, you authorise us to access them as described in the Privacy Policy, and your use of those services is governed by their own terms. We are not responsible for third-party services, and you can disconnect them at any time under Settings → Integrations.

5. Fees

Fees, if any, are as agreed with your organisation in an order form or plan. Unless agreed otherwise, fees are non-refundable, and we may suspend accounts with overdue amounts after giving notice.

6. Availability and changes

We aim to keep the Service available and reliable, but we do not promise it will be uninterrupted or error-free. We may change, add or remove features. We will give reasonable notice before any change that significantly reduces what the Service does for you.

7. Intellectual property

We own the Service, including its software, design and branding. These terms give you a limited, non-exclusive, non-transferable right to use the Service while your account is active. If you send us feedback, we may use it without any obligation to you.

8. Confidentiality

Each party will keep the other's non-public information confidential, and use it only for the purposes of these terms, except where disclosure is required by law.

9. Termination

You may stop using the Service at any time. We may suspend or end access if these terms are seriously breached, or if continuing would expose us or others to legal or security risk. After termination, your organisation can ask for an export of its data within 30 days. After that, we may delete it.

10. Disclaimers

To the extent the law allows, the Service is provided "as is", without warranties of any kind, including warranties of merchantability, fitness for a particular purpose and non-infringement.

11. Limitation of liability

To the extent the law allows, we are not liable for indirect, incidental, special or consequential damages, or for lost profits, revenue or data. Our total liability for any claim relating to the Service is limited to the fees your organisation paid us for the Service in the 12 months before the claim arose.

12. Governing law

These terms are governed by the laws of the Kingdom of Lesotho. The courts of Lesotho have jurisdiction over any dispute, unless the law requires otherwise.

13. Changes to these terms

We may update these terms. If a change is material, we will update the effective date and tell users in the Service or by email before it takes effect. Continuing to use the Service after that means you accept the updated terms.
